Terms of service

General terms and conditions of sale

Purpose

These General Terms and Conditions of Sale (the "terms of sale") govern the purchase of products made at a distance, via an electronic network, from the website www.vintageloop.it (the "Site").

The owner of the Site is Vintage Loop s.n.c. di Lorenzo Lupo & C., with registered office in Arcore (MB), Via Casati 167 – Italy – entered in the Monza and Brianza Companies Register under no. 12954350968, REA no. MB-2694614, VAT number and tax code 12954350968, certified e-mail (PEC): vintageloop@pec.it

Acceptance of the terms of sale

All purchases of products made through the Site (the "purchase contract") by users accessing it ("Customers") are governed by these terms of sale, by the provisions of the Italian Consumer Code (Legislative Decree no. 206 of 06/09/2005), section II – Distance contracts (artt. 50–67) – and by the rules on electronic commerce set out in Legislative Decree no. 70 of 09/04/2003.

By concluding the purchase contract in accordance with the procedure, the Customer accepts and undertakes to comply with these terms of sale.

The Customer is therefore invited to read these terms of sale carefully before carrying out any purchase and, once the purchase procedure provided by the Site is complete, to print and keep them.

Vintage Loop s.n.c. may amend the content of the terms of sale at any time and without notice: the purchase contract is governed by the terms of sale published on the Site at the time the Customer submits the purchase order.

Products

www.vintageloop.it is an online business engaged in the retail sale of second-hand goods, clothing and accessories.

All products offered are shown on the Site, in their respective sections, organised by product category.

The products and offers on the Site are available and valid for as long as they remain online and while stocks last.

The visual representation of the products on the Site, where available, normally corresponds to a photograph of the products themselves and is intended solely to present them for sale, without any warranty or undertaking on the part of Vintage Loop s.n.c. as to the exact correspondence between the image shown on the site and the actual product.

Product availability

Product availability refers to actual availability at the moment the buyer places the order. Such availability must nevertheless be regarded as purely indicative because, since several users may be on the site at the same time, products may be sold to other customers before the order is confirmed.

Even after the order confirmation e-mail has been sent, the goods may turn out to be partly or wholly unavailable. In that event the order is automatically amended by removing the unavailable product and the buyer is informed immediately by e-mail.

If the buyer asks to cancel the order, thereby terminating the contract, Vintage Loop s.n.c. refunds the amount paid within 14 days from the moment it became aware of the buyer's decision to terminate the contract.

Purchase procedure and conclusion of the contract

To conclude the purchase contract you must complete the electronic form and submit it following the relevant instructions. The form contains a reference to the General Terms and Conditions of Sale, images of each product and its price, the available means of payment, the delivery methods for the products purchased and the related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal, and the methods and time limits for returning the products purchased. Before the contract is concluded you will be asked to confirm that you have read the General Terms and Conditions of Sale, including the information on the right of withdrawal and on the processing of personal data. The contract is concluded when the seller receives the form completed by the user, after verifying that the data it contains is correct. The buyer is obliged to pay the price from the moment the online order submission procedure is completed. This occurs by clicking the "checkout" button at the end of the guided procedure. Once the contract is concluded, the seller takes the order in hand for fulfilment.

Registered users

When completing the registration procedure, the user undertakes to follow the instructions given on the site and to provide their personal data correctly and truthfully.

Confirmation in any case releases Vintage Loop s.n.c. from all liability regarding the data supplied by the user. The user undertakes to inform Vintage Loop s.n.c. promptly of any change to the data communicated at any time.

Should the user communicate inaccurate or incomplete data, or should the persons concerned dispute payments made, Vintage Loop s.n.c. is entitled not to activate or to suspend the service until the shortcomings are remedied.

When the user first requests the activation of a profile, Vintage Loop s.n.c. assigns them a username and a password. The user acknowledges that these credentials constitute the system validating the user's access to the Services and the only system suitable for identifying the user, and that acts performed through such access are attributed to them and are binding upon them.

The user undertakes to keep their access credentials confidential, to safeguard them with due care and diligence and not to transfer them to third parties, even temporarily.

Product prices

Product prices are clearly stated on the site; the price guaranteed to the Customer is the one published on the Site at the time the purchase contract is concluded.

The price set at the time of purchase is fixed and final. It does not include delivery costs, which are expressly stated in the order confirmation.

For delivery within the European Union, prices include the VAT applicable on the day of the order. They are therefore shown inclusive of VAT.

No further customs duties or VAT are payable for delivery within the European Union. Any change in the applicable rate may affect the sale price of the products in the catalogue.

For delivery outside the European Union, the customer must pay any customs duties, VAT or other taxes relating to the importation of the products into the country of delivery. The related formalities are the customer's sole responsibility, unless otherwise stated. The customer is solely responsible for checking whether the products ordered may be imported under the law of the country of delivery.

Vintage Loop s.n.c. issues a proper invoice for every order.

Means of payment

Payment for the products purchased is due at the time of the order.

Once the desired products have been selected, they are added to the cart. Simply follow the purchase instructions, entering or checking the information requested at each step of the process. Order details may be amended before payment.

Non-payment and retention of title

The products ordered remain the property of Vintage Loop s.n.c. until their price has been paid in full. Vintage Loop s.n.c. reserves the right to reclaim the products ordered in the event of non-payment.

Transfer of risk

Risk passes to the customer when Vintage Loop s.n.c. hands the products over to the carrier. Products travel at the customer's risk. The same applies to products sent or returned carriage paid.

During the withdrawal period the customer must look after the product with due diligence. The customer may handle the goods only as far as is necessary to establish their nature, characteristics and functioning, and is liable only for any diminished value resulting from handling beyond what is necessary for that purpose, in accordance with art. 57 of the Italian Consumer Code.

Delivery

The delivery area corresponds to the geographical area covered by the offer.

Delivery takes place within the times stated on the site and upon acceptance of the order by Vintage Loop s.n.c. or, where no delivery date is specified, within the period estimated when the delivery method is selected and, in any event, within a maximum of thirty days from the date of confirmation.

Products are delivered to the address given by the customer when placing the order.

Delivery is deemed to have taken place from the moment the product is handed over to the carrier. The delivery note issued by the carrier, dated and signed by the customer on delivery of the product, constitutes proof of carriage and release of the goods.

On delivery the customer must check the contents, conformity and condition of the products. In the event of delays, damage, total or partial loss or other problems, the customer is entitled to bring a claim against the carrier.

Before signing the proof of receipt of the parcel, while the courier is still present, Vintage Loop s.n.c. recommends that the customer:

  • check that the number of parcels received matches the number stated on the transport document;
  • check that the labels on the parcels show their name and address correctly;
  • check the external condition of the parcels: they must show no damage and must not have been tampered with (for example, sealed with the carrier's tape rather than the original tape, or damaged packaging).

If the customer finds anything wrong, they must sign the transport document adding the words "merce accettata con riserva" (goods accepted subject to reservation) and specifying the type of problem found. Entering such a reservation is a right established by the Italian Civil Code (art. 1698). If acceptance subject to reservation is not recorded together with the details of the problem found, returns for transport-related problems will not be accepted. Reservations communicated verbally to the courier have no legal effect.

Force majeure

In addition to the events normally recognised by case law, the following are considered cases of force majeure: total or partial strikes, whether internal or external to the company, the blocking of transport or supply for any reason, government or legal restrictions, IT failures, and the blocking of telecommunications, including networks and in particular the internet.

In the event of force majeure, performance of the order is suspended. If, after a period of three months, the parties find that the force majeure event persists, the order is automatically cancelled, unless the parties agree otherwise.

Collection of products where the customer is absent

If the recipient is absent at the time of delivery, the products must be collected at the address and in the manner indicated by the carrier. If they are not collected within the period set by the carrier, the products are returned to Vintage Loop s.n.c., which reserves the right to refund the price of the products while leaving the shipping costs payable by the customer.

Complaints

Complaints regarding the non-conformity of the products delivered with the order must be submitted in writing, by e-mail to info@vintageloop.it or by registered letter to the registered office of Vintage Loop s.n.c., immediately after receipt of the product. The customer must keep the original packaging and the delivery note.

Where there has been an error concerning the product purchased, the customer undertakes to return that product to Vintage Loop s.n.c. within 10 days of receipt, provided that it is returned unopened, in its original state and packaging, together with the accompanying documents. The transport costs of returning the goods are borne by Vintage Loop s.n.c. Once the product has been received in the correct form and manner, Vintage Loop s.n.c. sends the product originally ordered at its own expense.

Right of withdrawal

The full conditions for exercising the right of withdrawal, for refunds and for the exclusions are set out in the Returns and Refunds policy.

Warranty

The Buyer acknowledges that the Products are second-hand. Each of them is shown specifically on the website, where photographs of each Product are published, together with a brief description of materials, measurements, model and general condition, as well as any obvious defects or faults known to the Seller, including those arising from wear. The Products are sold and bought "as seen and approved", the Buyer acknowledging that the agreed price takes the condition of the Product into account.

The Seller is liable to the consumer Buyer solely in the event of an evident lack of conformity with what was stated and shown in the description, taking account of previous use, and limited to defects not arising from normal use of the item. This warranty applies for one year from delivery of the Product.

Processing of personal data

The buyer's data is processed in accordance with data protection legislation, as set out in the Privacy Policy provided pursuant to art. 13 of EU Regulation 2016/679.

Intellectual property rights

Vintage Loop s.n.c. owns the intellectual property rights to the site and the right to publish the material contained in the online shop catalogue, in particular the photographs, for which it has obtained the necessary authorisations from the persons concerned. Accordingly, the partial or total reproduction, on any medium, of the material making up the site and the catalogue, its use and its transfer to third parties are expressly prohibited.

Applicable law

Purchase contracts between the customer and Vintage Loop s.n.c., as owner of the site, are governed by Italian law.

Place of jurisdiction

For the settlement of any civil disputes arising from the interpretation, performance and termination of this distance sales contract, where the Customer is a consumer, exclusive territorial jurisdiction lies with the court of the consumer's place of residence or domicile, if located in Italy (art. 63, Legislative Decree 205/2006); where the Customer is not a consumer, the Court of Monza has exclusive jurisdiction.
